Investigators have decided that the Wyoming snowboarder who collided into a child and her mother at the Hogadon Ski Area did not appear to be committing any crime at the time of the fatal crash.

The Christmas Eve collision left Kelli Johnson in critical condition and killed five year old Elise Johnson and twenty-three year old Craig Shirley. Investigations in the case concluded that there is no indication of "chargeable activity." Witnesses of the incident stated that Shirley was traveling down the mountain at a very high rate of speed, approximately 40 to 60 miles per hour.

On account of one witness, Shirley didn't appear to be out of control. The witness also stated he would have only seen the two after cresting a small hill. The distance from that point was insufficient enough to prevent the accident from occurring.
