The State of Wyoming is petitioning the U.S. Environmental Protection Agency to reconsider its final Clean Power Plan rule.

Wyoming Attorney General Peter Michael, at the direction of Gov. Matt Mead, submitted a petition to EPA Administrator Gina McCarthy Monday afternoon.  According to a press release from the Governor’s office, the Petition for Reconsideration of EPA’s Final Rule on Carbon Pollution Emission Guidelines for Existing Stationary Sources was submitted by email and overnight mail.

“I am directing the Attorney General to use every tool in the legal toolbox to stop this arbitrary and extremely harmful rule,” said Gov. Mead.

The State argues in the petition that the final rule violates the Administrative Procedure Act, the Clean Air Act, and the Endangered Species Act.  In addition, the State asserts that the final rule is fundamentally different from the proposed rule, and that difference bears significant negative consequences for Wyoming.

The petition and all supporting documents submitted to McCarthy will be available on the Wyoming Attorney General’s website.
