RIVERTON, Wyo. (AP) — Fremont County Attorney Pat LeBrun will not seek the death penalty in the prosecution of Florin Brandon Wyatt.

The maximum sentence LeBrun might seek is life in prison without the possibility of parole.

The public defender's office had asked LeBrun to make a decision by June 3 because of the effect a potential death penalty prosecution could have on trial preparations.

Wyatt admitted to killing Riverton man Keith Stephenson with a claw hammer in March while living in a bedroom in Stephenson's basement.

After his arrest, Wyatt told police Stephenson had tried to kick him out of the house. Wyatt told police he also shot Stephenson after the hammer attack.

Wyatt's trial is set for Sept. 25.
